Buyer Representation
When you choose us as your Realtor, we’ll provide a Buyer Agency Agreement that outlines our partnership. This agreement not only fulfills legal requirements but also solidifies our commitment to guiding you through every step of your home or farm purchase. By signing, we establish a formal relationship, ensuring you receive dedicated support and comprehensive services throughout your buying journey. The Buyer Agency Agreement ensures that we act solely in your best interests, with honesty, transparency, and confidentiality. During our first meeting, we’ll explain the details of this agreement and how it guarantees your privacy and protects your personal information. Once signed, your goals become our top priority. We’re here to guide you with integrity and care, making your home-buying experience smooth and stress-free. If you have any questions about the agreement or our role, don’t hesitate to reach out. Our goal is to keep you informed, confident, and comfortable every step of the way.
Professional Fee
At the Seller’s discretion, the Listing Brokerage may offer compensation to the Buyer’s Brokerage as part of the transaction. If the Seller chooses not to provide this compensation, the Buyer still has options. In the written offer, the Buyer can request that the Seller cover part or all of the compensation owed to the Buyer’s Broker. This request is negotiable and, if agreed upon, can be factored into the final sale price or paid at closing. If you have any questions about how buyer broker compensation works, feel free to reach out. We’re here to guide you through the process and address any concerns as you search for the right buyer’s agent. Our buyer representation services are exceptional, and we look forward to the opportunity to represent you.
Direct Approach to the Seller’s Agent
What Buyers Need to Know
Understanding the Seller's Agent's Role
The seller’s agent, or listing agent, is dedicated to representing the seller’s interests. Their main responsibility is to facilitate the sale of the property and secure the best possible deal for their client—the seller. While they can provide valuable details about the property and transaction process, their loyalty remains with the seller.
Limitations in Advising Buyers
By law and ethics, the seller’s agent must act in the best interests of the seller, meaning they cannot offer advice that favors the buyer. They can answer property-related questions and explain the offer process, but they cannot guide buyers on structuring an offer or negotiating terms in their favor. Buyers seeking such advice will need to rely on independent research or consult an outside professional.
Potential Risks and Benefits of Working Directly with the Seller's Agent
Opting to work directly with the seller’s agent can save on the cost of a buyer’s agent commission, which can be appealing to some buyers. However, this approach requires buyers to be more informed and proactive. Without the support of a dedicated buyer’s agent, buyers may miss out on expert advice, negotiation strategies, and market insights that could result in a more favorable deal.
Direct Approach with Legal Support
For buyers who choose to work directly with the seller’s agent, enlisting a real estate attorney can help safeguard their interests. Here’s how the process works when legal support is added:
Attorney Advisory Support
Buyers can hire a real estate attorney to provide crucial legal guidance, including contract review, offer strategies, and overall protection of the buyer’s interests. This ensures that buyers receive expert advice despite not having a buyer’s agent.
Offer Preparation by the Seller’s Agent
The seller’s agent can handle drafting the buyer’s offer, incorporating agreed-upon terms. While the agent handles administrative tasks, the buyer’s attorney ensures the legal aspects of the offer are sound.
Balancing Risks and Benefits
Working directly with the seller’s agent can lead to savings on commissions and offer logistical support. However, combining this approach with legal assistance from a real estate attorney ensures the buyer’s interests are fully protected. This strategy gives buyers the legal guidance they need while still benefiting from the administrative expertise of the seller’s agent.
Thank you for considering us for your real estate needs. Whether you need a dedicated buyer’s agent or are exploring a property where we represent the seller, we’re here to provide all the information and support you need.
